They are no longer in business when it comes to releasing/licensing new DVDs/BDs. For me it comes down to what BEI really meant by digital distribution, broadcast, and merchandising. I consider them in business even if BEI is only licensing the various rights and then someone else will be distributing it (if a physical product). And anything they have said thus far can always change.

Toei USA is probably the best comparison of the ones you used here (especially considering BEI's focus now shifts toward ). Kadokawa USA handled distribution (back then the focus appeared to be more toward physical disc releases) and they have been gone since '09. As to Geneon USA, it's anyone's guess if there is anyone left for the paperwork stuff.

That's pretty much known for quite a while now. Some aspects known publicly more than the others (like Kurokami). I don't think anything changed in terms what they are allowed to do. It remains to be seen on what digital distribution, broadcast, and merchandising will really do for BEI.
