An extra who worked on last year's PLANET OF THE APES is suing 20th Century Fox for, as THE HOLLYWOOD REPORTER story states, "fraud and deceit, battery, conspiracy, intentional infliction of emotional distress, negligent infliction of emotional distress and unlawful business practice."

The suit, filed by Jeffrey Clark, alleges the final fight in the desert utilized a type of movie dust, Fuller's Earth, that is a chemical cousin to asbestosis. According to the suit, "Defendants knew or should have known that the product they used can cause silicosis, which is very similar in effect to asbestosis and can take literally years to appear in individuals who have been exposed."
