I would wet my pants if this was true. However:

In response to speculation that Philip Seymour Hoffman was approached for the role of the Penguin, as a British arms dealer in The Dark Knight, franchise director Christopher Nolan said he considered the character difficult to portray on film, explaining, "I'd be more excited to have Philip Seymour Hoffman in the film than to have the Penguin. There are certain characters that are easier to mesh with the more real take on Batman we're doing. The Penguin would be tricky."

Also:

The Dark Knight co-writer David Goyer has revealed that Catwoman and the Penguin are unlikely to feature in future Batman sequels.

Goyer explained that, despite re-introducing the Joker in the upcoming sequel, the filmmakers want to explore new villains in future films.

Mind u this is from wikipedia and the first thing the source is no longer available. Plus, I doubt WB wouldn't want to go with more the A list cast of Bat villains.
Anyway, if this is remotely true, I like i said will wet my pants.
