Fox Sues WB Over WATCHMEN

Another potentially high-profile film in jeopardy over a lawsuit, this time centering on Fox, Warner Bros. and the upcoming Watchmen from director Zack Snyder. Fox has initiated a legal battle against Warner Bros. over the rights to develop, produce and distribute a film based on the graphic novel Watchmen, says The Hollywood Reporter

Fox seeks to enjoin Warner Bros. from going forward with the project, saying in the lawsuit that it seeks to "restrain (Warner Bros. Pictures) from taking actions that violate Fox's copyrights and which stand to forever impair Fox's rights to control the distribution and development of this unique work."

Fox claims that between 1986 and 1990, it acquired all movie rights to the 12-issue DC Comics series and screenplays by Charles McKeown and Sam Hamm. In 1991, Fox assigned some rights via a quitclaim to Largo International with the understanding that the studio held exclusive rights to distribute the first motion picture based on Watchmen, according to the lawsuit.

When Largo dismantled, the rights were transferred to producer Lawrence Gordon. Under a "turnaround agreement" between Fox and Gordon, the producer agreed to pay a buy-out price to Fox if he entered into any agreement with another studio or third party to develop or produce Watchmen, among other things.

Now, Fox claims that neither Gordon nor Warner Bros. has paid the buy-out price or advised the studio of any other conditions required under the agreement, including procedures necessary to acquire the rights to Watchmen from Fox.

Warner Bros. plans to release on March 6, 2009 a big-screen version of the popular graphic novel written by Alan Moore and illustrated by Dave Gibbons. The film is directed by Zack Snyder (300) and stars Patrick Wilson, Jackie Earle Haley, Matthew Goode, Billy Crudup, Jeffrey Dean Morgan, Malin Akerman, Carla Gugino, Stephen McHattie and Matt Frewer.

This suit has no merit...and Warner should counter sue Fox for malicious meddling in willfully filing a frivolous lawsuit...as a part of a conspiracy to undermine the potential success of this film in order to protect its X-Men film franchise!!! If Fox had an issue with Warner over this film...they had an obligation to raise their concerns when Warner first announced its intentions to produced Watchmen...but they, Fox failed to do so in a timely manner. Likewise, they did not voice their concerns, if any, over the production of Watchmen as it commenced its live action filming and post production effects. That being highlighted best by the fact that Fox has filed this lawsuit...and suspeciously so, less than one month before the scheduled release of the film in question.

This is simply about Watchmen being seen as a threat to the continued health of The X-Men franchise...nothing else. That said...I believe that this may violate the RICO Act...as it appears that Fox is engaging itself in the illegal practice of racketeering...unethically, to that end, highjacking the legitimate legal process to do so.

Now...Warner, please...give me a job...I have a script to sell...and it is good!!! Besides, you know you love my legal language, and that is why you'll be using some of it when you file your legal response to this suit.

Very interesting FOX. First you crank out the crapfest that was League of Extraordinary Gentlemen that you fought to get the rights and you called it LXG in promotional advertisements which nearly got you in trouble with X-Men creators while and STILL under your banner. You go in, you pull out, you go in, you pull out of Halo more times than you take a dump on a toilet and now you here you come about Watchmen. Where was this complaint 5 months ago?? What was that FOX??? I CAN'T HEAR YOUUUUUUU!!! If anything FOX, I should sue your sorry...shameless Beverly Hillbilly....flea-infested pot smokin....no pancake havin ass for turning AVP into a movie malpractice debacle. NOW PUT THAT IN YOUR GODDAMN PIPE AND SMOKE IT!!

I am in no way defending Fox and it sounds to me that the suit should have been filed months ago seeing as how the news of this movie coming out has been all over the place, but Metal, what are you even basing your comments on? This may or may not have something to do with the X-men franchise, but I doubt seeing as how the 2 stories are absolutely different and how would stopping Watchmen from being made help the X- Franchise. From what it sounds like to me, Fox actually wants to make the Watchmen film themselves and feel that they have the legal right to do so where the WB does not. Or they at least want the buy-out money that they are apparently due, but like Mlaforcer said, lets just leave this to the experts and see what happens. No need to fly off the freakin handle.

Ahhhh...god bless this litigious nation that is America......lol.....this does seem more of Fox having their panties in a twist for never getting the movie made themselves. I am sure there will be a settlement and Fox will move on and the movie will get made......and Metal, you seem like the type of guy that would try to sell flys to the Ethiopians....trying to pimp a script for shame,,,,,,Do you really think someone is gonna read your little tirade and be like "wow, we need a script from him?"...lol,,,,too funny,,,,no, wait,,,,,sad.

Am i the only one who thinks that metalwater likes to stone puppies on his free time and also, kidnaps little children and hides them in his basement? Hope im wrong.. Anyways, im guessing that all fox wants is a slice of the pie and That's why they waited until now to sue warner bros.. Im guessing they will settle out of court or something to that effect... Watchmen will come out to theatres no matter what

I am very good with strategy...and the Fox suit, on the face of it, has no merit A judge will dismiss it...and it it goes to a jury fox will lose. They should have filed this lawsuit in a timely basis...they didn't and that exposes the fact that they, Fox, clearly have alterior motives. Now...when something doesn't make sense, and very rich and very powerful people are behind it, trust me, it makes sense to someone...you just have to figure out what the scheme is. The stated intent of the suit is just misdirection, the true intent??? Clearly, as I said before, it can only be to protect the X-Men franchise from competition.

You'll all recall that Fox threatened a suit over the movie Zoom...about a team of young super heroes, claiming it was unfair competition and that it could harm its X-Men franchise. Well, they forced the distributor to make changes and move the film's release date...and this is just a continued pattern of these kinds of Fox protectionist actions. You'll also recall Fox firing Bryan Singer and the actor who played Cyclops from the X-Men franchise when they signed to take part in Warner's Superman returns. Other X-Men alumi were also threatened with dismisal if they associated themselves with Singer's production. Next, Fox rushed X3 into production to steal the thunder away from Superman Returns. Not that I am a fan of Superman Returns...and yes X3 is the better movie between the two...but Fox was attempting to undermine Warner's efforts to jump-start its sagging super hero franchises. That doesn't excuse Warner for stealing Singer, but then...they didn't put a gun to his head either...they just paid him the kind of money Fox has refused to pay many of the up and coming filmmakers in its stable of talent. Joss Whedon...anyone??? This is about market protectionism by Fox. They have pretty much cornered the market, save for Sony's Spiderman...on super hero based movies...meaning billions to Fox, hence the reason why they wish to slow Warner's efforts to rebound in the marketplace. Again, this is a continued pattern by Fox...and you don't have to be an insider to figure this one out...it's obvious.

Remember, this is from the same guy who told you months ago that the Hollywood writer's strike would be settled in late January or February of this year...well...???
