Quite simple...he is the one thinking in flashbacks. Shatner's Kirk is dead.

I think they are missing a huge opportunity here. Superman Returns introduced some pretty amazing technology in creating footage of Marlon Brando that never truly existed (matching a computer generated face with recorded audio cut from previous Superman flicks). If they are so insistent to ressurrect that ST franchise in a remake, Abrams and co. should come to an understanding that they are going to have to do something truly innovative if they are going to win over diehard fans. The tech has had more than a year to percolate since Singer's Superman. They should consider it for ST. If it were me and Paramount was deadset on TOS era, I would at the very most have a cameo of Kirk and the original cast, using the tech from SR, and have the plot itself focus on a whole new crew. That would ensure they didn't have to animate nearly 2 hours worth of footage.
