McClory Loses Out of JAMES BOND

Producer Kevin McClory's latest attempt at legally wresting some control of the JAMES BOND franchise has been shot down. McClory, who came into partial ownership of the character due to a lawsuit settlement on his script collaboration with Bond creator Ian Fleming for 1965's THUNDERBALL, has, over the last few years, been making attempts at either launching a new BOND franchise, or getting a piece of the existing one.
The latter was the case in a lawsuit filed by the producer claiming that he was a co-creator of the cinematic version of 007.
On Monday, though, a three-judge panel of the 9th U.S. Circuit Court of Appeals upheld a previous ruling by a lower court that had dismissed the lawsuit, saying that McClory had waited too long to assert his rights to the character/franchise.
Still, McClory did manage to remake THUNDERBALL in 1983 as NEVER SAY NEVER AGAIN, which brought back Sean Connery to the role of James Bond.
