personally, I think this is just crap, probally trying to raise some more awareness to the Avengers franchise

I'm gonna say some statements that could sound conflicting. So bear with me.

I'm witth booker9172 - I love Jim Starlin's work. If you have never read the Warlock saga he did in the 70's,  you're missing out. It's by far one of the most important, ground-breaking and influential comic stories ever wirtten. And it's good to boot. His work was so far ahead of everything else at the time it's not even funny. Come on, Batman was going through his paces, Superman was fighting Amazo with the Supermobile (seriously.. check it out, issue #481 and 482), The Fantastic Four was taking on some cosmic hockey player (again.. check out issue #163)
 

yet with Warlock, we had someone questioning their existance, and purpose, and finding it, as unpromising as it seemed.

Having said that, I think that Starlin could have a legitimate beef, since he did create the character prior to working for Marvel. That was the issue with the Kirby lawsuit. His estate claims he created the characters on his own and brought them to Marvel. They didn't have anything in writing to prove those claims, unlike Starlin, and that's the main reason they lost the suit.

I am a huge fan of Jack Kirby as well, however even I could see that the suit was pretty hopeless, especially since I read an article stating that they had an affadavit signed by Kirby from the late 70's stating that he knew the work he did was work for hire.

And one last thing. Someone stated that DC does cosmic better than Marvel... really? lay off the crack. DC, does overpowered superheroes better than Marvel, but Marvel's cosmic storylines are much more co-herent than most of the dreck DC has cranked out. (excluding the original Crisis, and Blackest night)

I only have one real oppinion on this whole matter. If a lawsuit slows down the production of a part 2 ov Avengers or Thor old Jimmy boy is going off my Christmas mailing list.

Its funny....all of a sudden Starlin's concerned.....even after all the shit that went down with superman copyrights, watchmen copy rights , and all the other stuff..........Now Starlins concerned???

Thanos and the Infinity Gauntlet only became popular once Starlin used Marvel's pre-existing characters and comic book industry infrastructure.  OK, so he created Thanos before he went to work for Marvel.  Maybe Marvel should take credit for making his crappy intellectual property popular.

OK, I don't think of it as "crappy intellectual property", but I just worded it that way to state my case.  If you think of it that way, this argument can begin to get a different outlook.

Wasn't a law suit by the creator of Ghost Rider just thrown out of court? On basically the same grounds that the Kirby's lost thiers?

"Thrown out"...no, Gary Friedrich would be in better shape if it had been thrown out as Marvel not only wound up winning they got a court injunction won to keep him from appearing at conventions and billing himself as the creator of Ghost Rider, a prohibition on selling Ghost Rider merch of his own (apparently he was doing this at some point before he sued Marvel) and an order to pay $17,000 to Marvel -which by the way he doesn't have as amazingly comic writting isn't that profitable and also doesn't include any sort of pension or health benifits when the artist/creator get old and tend to need them.

Now the situation may be different as Friedrich didn't have records of the creation of GR (or co as may be more likely as two other men claim they had input as well) and the Kirbys also didn't have prepublication material to show either, though if Marvel has documents showing he signed over the rights or that because he agreed to put his character in their comics it gave them some proprietary rights it may be a long battle ahead and a prolonged fight is simply a major advantage to Disney as they have their own law department and dragging out lawyer costs may not be possible for Starlin.

It is also (legally if not ethically) in Disney's best interest to win these suits in as big a manner as possible to set up precident and frighten away other creators who may come forward looking to profit from the work they created while doing work for hire for the company.

Hey I created the concept of the cab they destroyed in the street during the Avengers, I want my credit (money). Seriously dude, 40 freaking years later, hundreds of comics and NOW you decide to pipe up? Gee the fact the film made 1.5 BILLION dollars might not have something to do about it? Hey here is a question, how come you never, EVER, addressed this during the Infinity Gauntlet series or the other hundreds of comics they used your work in? Oh wait you were WORKING for the company at the time. Even if you come up with an idea prior to employment of a company, you bring that idea to a company and they use it, you lose financial compensoratory rights to said idea. Shove off and stop gold digging you troll. You got paid and you made a bad call. Sorry mate. I hate crap like this because it takes away from the bringing these characters to the big screen.

If I were Marvel I would tell him (fine, pay us back all your salary, the cost of developing said character and then we will sign over rights to the character to you and take him out of the universe. How is that for being a Mad Titan? Now STFU and go away"

Go for it Jim, good on you for standing up for your own creation.  You are entitled to the many millions you will get from this lawsuit.
