Tolkien Estate Sues New Line

Just two weeks after Guillermo del Toro was confirmed as director for the two upcoming Hobbit films, a new press release has been issued from the estate of LOTR author J.R.R Tolkien announcing their intentions to sue New Line over profit sharing. Here's that statement:

The trustees of The Tolkien Trust, a British charity, have filed an action against New Line Cinema for its failure to pay a contractually required gross profit participation in the three films based on the world-famous Lord of the Rings trilogy. The trustees of the estate of JRR Tolkien and HarperCollins Publishers are co-plaintiffs in the lawsuit. The suit was filed today in Los Angeles Superior Court.

The Lord of the Rings films produced by New Line are among the most financially successful films ever created by Hollywood and were released in 2001, 2002 and 2003 respectively. The cumulative worldwide gross receipts to date total nearly $6 billion. Notwithstanding the overwhelming financial success of the films, and the fact that the plaintiffs have a gross participation in each of the films, New Line has failed to pay the plaintiffs any portion of the gross profit participation at all.

The trustees' UK lawyer, Steven Maier, of Manches LLP, said: "The Tolkien trustees do not file lawsuits lightly, and have tried unsuccessfully to resolve their claims out of court. But in this case, New Line has left them no option at all. New Line has not paid the plaintiffs even one penny of its contractual share of gross receipts despite the billions of dollars of gross revenue generated by these wildly successful motion pictures. To make matters worse, to date New Line has even prevented the plaintiffs from auditing the last two films of the series. The trustees are very aggrieved by New Line's arrogance."

The complaint seeks, among other things, in excess of $150 million in compensatory damages, as well as punitive damages, and a declaration from the Court that the plaintiffs have a right to terminate any further rights New Line may have to the Tolkien works under the agreements, including The Hobbit, due to the serious and material nature of the breach of the agreements.

Bonnie Eskenazi, the trustees' US counsel who filed the complaint, said, "New Line has brought new meaning to the phrase 'creative accounting.' I cannot imagine how on earth New Line will argue to a jury that these films could gross literally billions of dollars, and yet the creator's heirs, who are entitled to a share of gross receipts, don't get a penny."



JRR Tolkien is the world-renowned author of the "Lord of the Rings" trilogy and "The Hobbit." The Tolkien Trust is a UK registered charity that has made grants to charitable causes all over the world totaling over $8 million in the last five years alone.

That's right, Get what's owed you and f*ck New Line and those greedy c*ck suckers...They thought they could get away with it, Jackson being 4000 + miles away and the Tolkien Estate should just be happy with what New Line gives them but little did they know, those two groups are smarter than New Line and will not take it in the As*...Get what's owed you and then get more with the Hobbit, of course that's just me and the alcohol talking lol

well if you ask me, why did the charity wait this long to sue New Line Cinema? the movies were released in 01,02 and 03 and now its 2008 and they're just now sueing over lost royalties? Hmmm... I'm not saying they arent entitled.. but they should have sued when Jackson sued, that would have given their claim more weight in court.

That is the one thing I can never understand when we hear these types of stories. Why the hell do they take so long to decide to sue. if someone owed me dough and I had evidence to the fact,I would be in that lawyers office the next day. Do they have so much money, that they didn`t realize someone owed them £150 million dollars?
That being said, i`m not surprised that this happened after what New Line did to Jackson. They really need to be investigated for bad business practices. Them not paying up seems to be a trend.

And now, the word is New Line is near it's end... well, as far as big budgets are concerned. Time Warner is planning to limit them to small budget films again and leave the others to WB. Or they might just fold it altogether. "Or they might just fold it," said all, together. :)

No..here's the real story, if you read between the lines. (or maybe I'm off base).

The Tolkien estate (bucha stuck-up prats with the exception of Christopher) did not want New Line or anyone making LOTR into movies. They bitched and whined back when the trilogy was being made. They refused to have any part in it.

Now, suddenly, they want their money. Money they wouldn't be owed if they had gotten their way originally. Personally, for the bitchfest they held back in 2000 and on, they don't deserve any royalties for the movies. Just keep collecting on the books and merchandice..

But now, on the eve of 2 new movies being made, they bring suit and threaten to stop the next movies. Here's a chance to say, "hey...we're the Tolkiens. Look at us. Aren't we great."

Now if someone would kindly pull the stick out of their collective arses and explain to them that they'd make more money with two new movies being made. Plus the movies would generate more book sales.

*this is in no way meant to be construed as a defense for New Line's shoddy accounting practices.

And the hobbit movie will now have wait again, no wonder guillermo del toro jumped ship, he probably saw this coming and knew better then to sign into a messy situation.. Sorry lotr fans, but it looks like your hobbit movie will not walk into a theatre near you anytime soon....

I know it is evil, but sometimes suing is legit. Here in the US in NJ, where I live, we have like 1 lawyer for every 4 people. That is fucked up. People are afraid to do anything becuase people sue nowadays if you fart and it smells like last night Indian dinner, and they don't like catching a waft of it......I mean, get the fuck over it people. I think it was said best in "Back to the Future II", when Doc Brwon Says " The Legal system movies much faster now that we have abolished all Lawyers!!".....and LOTRSUXS, where does it say Guillermo DelToro bailed on the project?

what the heck is going on over at New line??!! First, the whole Jackson mess, and now this?? It's not like the movies didn't make money--there was plenty of it to pay everyone and still wallow in obscene amounts of profit!! By trying to hold back and be greedy, they will now wind up paying more than they would have had they simply paid everyone straight up. The sad thing about all of this is that New line is now getting a very bad reputation--people will start to think twice before signing up to do business with them.
